1.1 These Creator Terms ("Creator Terms") govern the provision of games by users ("Creators") on the Minit Games platform ("Minit Games") operated by Drop GmbH ("Drop").
1.2 They supplement Drop's currently applicable Terms of Use ("Terms of Use"). In case of conflict, the Creator Terms prevail.
1.3 The Creator Terms apply to all games, content, updates, expansions and other contributions uploaded by Creators.
2.1 Use of the Creator features requires a registered user account ("User Account"). Only one User Account is permitted per user; multiple accounts are prohibited.
2.2 Drop may establish additional requirements for the use of Creator features, in particular regarding the identification of the Creator, the provision of payment information and compliance with legal requirements.
2.3 The Creator warrants that all information provided during registration and use is complete and accurate.
2.4 Drop does not store the text of this agreement. The Creator Terms are made available during the registration process and can be downloaded at https://minit.games/creator-terms/.
2.5 The language of this agreement is English.
3.1 The Creator may upload games the Creator has developed himself ("User-Generated Content", "UGC") to Minit Games and make it available to other users on the Minit Games platform.
3.2 By uploading UGC, the Creator grants Drop a simple, non-exclusive, worldwide right in perpetuity to use the UGC for the purpose of making the UGC available on Minit Games to the extent specified in these Creator Terms, in particular to use, reproduce, modify, create derivative works of, distribute, transmit, transcode, translate, broadcast and otherwise disseminate the UGC, as well as to publicly display and perform the UGC, to train AI models (to the extent that this directly serves the operation, moderation, security, discoverability or further development of Minit Games), for the operation, distribution and integration of the UGC as part of Minit Games, Minit Games titles or other offerings from Minit Games, as well as for the promotion thereof.
3.3 Furthermore, the Creator grants Drop and interested users of Minit Games the right to edit UGC so that users can modify such UGC and then make such modified games available on Minit Games.
3.4 The Creator warrants to Drop that the Creator is authorized to grant the rights specified in Sections 3.2 and 3.3 and that the UGC the Creator has uploaded does not infringe any third-party rights.
3.5 The rights granted pursuant to Sections 3.2 and 3.3 are granted free of charge.
3.6 Furthermore, all rights to the UGC not granted in this agreement remain with the Creator.
3.7 UGC can be uploaded in HTML5 format via Minit Games.
3.8 The Creator has no right to publication or permanent availability of UGC.
3.9 Drop is entitled to reject, block or remove UGC if:

4.2 The Creator shall indemnify Drop against any third-party claims arising from a culpable breach of these representations and the warranty set forth in Section 3.4. The indemnification also covers reasonable legal defense costs.
Minit Games provides a reporting form to report illegal content in UGC. This form enables and facilitates the accurate and substantiated reporting of illegal content in UGC and is intended exclusively for such reports. Upon receipt of a report, Minit Games sends the reporter an acknowledgment of receipt, then reviews the report and, if appropriate, gives the affected Creator an opportunity to respond, makes a decision and notifies the reporter of this decision, including information about available legal remedies.
Consumers are entitled to the statutory warranty rights in the event of defects in digital products.
7.1 Drop may organize competitions, game jams, seasons or other events ("Events") as prize competitions pursuant to Section 661 of the German Civil Code (BGB), in which UGC from various Creators competes.
7.2 Participation in Events is voluntary and free of charge. No participation or entry fee is charged, and there is no obligation to publish new UGC.
7.3 Drop may select UGC for participation in Events. If Drop selects UGC for participation in an Event, the Creator of the UGC will be notified by Drop. The selected UGC will participate in the Event unless the Creator objects to the participation within fourteen (14) days of being notified.
7.4 Only UGC that was published on Minit Games during the Event period ("Post", meaning a specific UGC level) by a Creator who was of legal age (at least 18 years old) at the time of upload may participate or be selected. UGC with new Posts (new levels) may participate in other Events; however, a single Post may only ever participate in one Event. In the case of multiple submissions, the first Post submitted counts.
7.5 Participating or selected UGC must be the Creator's own original work and must comply with these Creator Terms, the Terms of Use and any specific terms of participation. UGC created collaboratively may only be submitted via a single Creator account; any prize money must be divided among the members of the group internally.
7.6 Entitlement to prize money is governed exclusively by these Creator Terms and the respective Event Rules. In addition to the cases specified in Section 17.2 of these Creator Terms, there is no entitlement to prize money in the event of a technical failure of Minit Games, in the event of proven manipulation to an extent that jeopardizes the respective Event, in the event of obstacles arising from legal regulations or official orders, in cases of force majeure, or if the number of eligible UGC is lower than the minimum specified in the respective Event Rules.
7.7 Employees of Drop and its service providers, as well as employees of Event sponsors, including their respective household members, are excluded from participating in Events.
7.8 Events are generally held worldwide. Excluded are countries where participation or payment of winnings is prohibited by law or where payment of winnings via PayPal is not possible.
8.1 For each Event, Drop publishes binding event rules ("Event Rules") for the prize competition prior to its start. The Event Rules include at least:
8.2 The respective Event Rules are published on Minit Games before the start of each Event and apply exclusively to that Event. They become an integral part of these Creator Terms. For ongoing Events, only the Event Rules published at the start of the Event apply.
8.3 Drop will review submitted or selected UGC for compliance with the Creator Terms and the Event Rules; in particular, Drop reserves the rights set forth in Section 3.9 of these Creator Terms.
8.4 The time in Drop's time zone (as displayed on Minit Games) is decisive for the submission deadline. Drop is entitled to extend submission deadlines by up to 7 days prior to their respective expiry by posting an announcement on Minit Games.
8.5 Drop is entitled to cancel an Event at any time prior to the first submission of UGC.
8.6 If the Event Rules so provide, submitted or selected UGC will be published simultaneously upon expiry of the submission deadline. Once published, changes or withdrawals are generally no longer possible.
9.1 Placements in an Event are determined according to the respective Event Rules. Depending on the Event, the decision may be made in particular through:
9.2 Only participants who are placed according to the respective Event Rules are entitled to the prize money. Participants who are not placed do not receive prize money.
9.3 Provided the evaluation is conducted in accordance with the published Event Rules, the decision is final. The winning placements are published on Minit Games. Complaints from Creators regarding the placements must be sent to [email protected] within 14 days of the announcement of the placements.
9.4 Only players logged in to Minit Games may participate in player voting. Creators may not vote for their own submitted UGC. "Vote buying" (casting a vote in exchange for something in return) is prohibited. Invalid player votes (in particular those resulting from bots, multiple accounts, vote buying or technically flawed vote submissions) are excluded from the vote regardless of their cause.
10.1 Prize money is awarded exclusively as recognition of a placement within an Event, not as a distribution from a prize pool; prize money for unfilled placements (in particular due to an insufficient number of participants) remains with Drop. The prize money does not constitute compensation for uploading UGC, using UGC, granting rights or any other services provided by the Creator.
10.2 If multiple submissions receive the same score, they share the placement (two first places, the next is third). The prize money of all placements they occupy is divided equally among them, rounded down to the nearest cent. Any remainder remains with Drop.
10.3 By awarding prize money, Drop does not acquire any additional rights to the UGC beyond the license already granted under Section 3.
10.4 The Creator is not required to perform any specific action to receive prize money.
10.5 A claim to prize money arises upon the determination of the respective placement in accordance with the Event Rules. Outstanding prize money is displayed in the Creator's account. Multiple prize amounts may be paid out collectively. There is no minimum amount.
11.1 Outstanding prize money is paid out upon the Creator's request. This requires a complete payout profile of the Creator on Minit Games, including:
11.2 Drop pays out due prize money within 20 business days of receiving a valid payout request. Drop may suspend the payout if the review in accordance with Section 8.3 of these Creator Terms has not yet been completed.
11.3 If the Creator account is terminated, Drop pays out any outstanding prize money without undue delay upon receipt of the necessary information.
12.1 Prize money is awarded exclusively in U.S. dollars (USD). The Creator can choose between USD and euro (EUR) in the payout profile. Drop does not charge any additional exchange rate fee for this. Any marketing features (e.g. featured placements, social posts) that Drop may offer to winners are not part of the prizes.
12.2 If payout in EUR is selected, the conversion is based on the European Central Bank's reference exchange rate on the day the payout is requested. The exchange rate used for the payout is shown on the payout statement.
13.1 Payments are made exclusively via PayPal to a PayPal account in the Creator's name.
13.2 Drop may suspend or refuse a payout as long as:
13.3 In the event of a violation of the rules of the prize competition, Drop may revoke prize money and reject corresponding claims. When taking action, Drop considers the severity of the violation, the Creator's legitimate interests and the principle of proportionality.
14.1 For each payout, Drop provides a payout statement ("Prize Payout Statement"). The statement includes, among other things, the Event name, the placement, the prize amount, the payout date, the statement number and the payout currency.
14.2 The Prize Payout Statement does not constitute an invoice. No VAT is shown. The Creator is solely responsible for the tax treatment and taxation of prize money received.
15.1 Prize money may be funded by sponsors. Unless otherwise specified in the Event Rules, Drop remains the organizer of the Event and the party responsible for paying the prize money.
15.2 By participating in a sponsored Event, the sponsor does not acquire any rights to uploaded games. Drop and the sponsor are nevertheless entitled, but not obligated, to use UGC titles (game titles), preview images, the Creator's name and UGC/game placements for the purpose of communicating about Events in which the Creator's UGC is, was or will be featured.
15.3 If a sponsor provides protected intellectual property ("Protected Intellectual Property") for an Event, Creators are granted a non-exclusive, non-transferable and non-commercial right to use such Protected Intellectual Property solely for the purpose of creating and publishing their UGC for that Event on Minit Games, to the extent described in the Event Rules. In particular, Creators may not combine the Protected Intellectual Property with other intellectual property of third parties or use it outside of their own UGC. The respective Event Rules specify what happens to UGC containing Protected Intellectual Property after the Event. The use of Protected Intellectual Property does not affect the Creator's own rights to the UGC.
The claim to payment of prize money expires 3 months after separate notification of the winning entitlement if the Creator has not submitted payout information despite two reminders.
17.1 Any manipulation of rankings, votes, game statistics or Event results is prohibited. The following in particular are prohibited:
17.2 In the event of violations of these rules, Drop is entitled in particular to remove content, suspend Creator accounts, exclude participants, revoke prize money and reclaim prize money that has already been paid out. When taking such measures, Drop considers the severity of the violation, the Creator's legitimate interests and the principle of proportionality.
Drop may amend these Creator Terms for future uploads and future Events. For Events already in progress, the rules published at the start of the respective Event continue to apply.
19.1 The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods.
19.2 Mandatory consumer protection laws of the country in which a consumer has their habitual residence remain unaffected.
